 税收征管档案(以下简称档案),是指在税收征收管理过程中以及在税务行政复议、诉讼、国家赔偿等活动中以计算机、纸质资料、磁带、光盘、胶片等为载体,以文字、图表、声像等形式存在的卡、表、证、单、书、帐、册、票等各种涉税资料通过采集、整理、归档后形成的具有保存和使用价值的历史记录。

  税收征管档案同时包括市局和县(区)局机关各部门按照《XX 省 XXXXXX 税务管理操作规程》的要求形成的,除应归入文书档案、人事档案、计财档案、监察(审计)档案以外的档案。

 第十二条

 稽查档案是指各级税务稽查部门进行税务检查、处理和执行过程中,通过收集证据、制发文书等形成的档案。对举报信息、协查信息和集中性检查应按类专项立档。对各主管税务机关开展的日常检查(结算)应归入该纳税人的管户档案。

 第十三条

 业务档案是指市、县(区)局各科(股)、室、中心按《XX 省 XXXXXX 税务管理操作规程》的要求收集的各类工作资料、报表、分析报告等资料形成的档案。

 第二十三条第五款 稽查档案实行一户一档或一档多卷制。对税务稽查尚未执行完结的案件,在年度终了后也要进行收集、整理、编制清单移交档案室监管,待执行终结后编制目录归档。

 档案的收集(录入)和按户整理工作由本单位税务人员负责,于年度终了后二个月内将档案移交给档案管理员,并在移交时填制《税收征管档案移交清单(一)》(见附件一)。

 第二十七条

 稽查档案一般按照税务文书部分、证据材料部分、备考材料部分的顺序归档。

 (一)税务文书部分,按照结论类、执行类、审理类、稽查类、选案类等文书的顺序排列。

 (二)证据材料部分,按照稽查报告认定事实的顺序排列,稽查工作底稿后直接附加相关的证据材料,对当事人、证人的陈述、询问笔录应将最后一次综合性笔录排列在前,其余分对象、按时间顺序排列。

 (三)备考材料按照需要说明的问题、拓展案件情况、大要案上报材料、案件公告、媒体报道的材料等顺序排列。

 四、对清册档案和业务档案的整理应当按照《XX 省 XXXXXX税务管理操作规程》所列各卷(档、册)的名称和类别分别归档,然后按照其所列顺序依次排列,最后对同类资料按照时间的先后顺序进行排列。

 第三十一条

 税务人员对档案进行整理后,应将资料装入档案盒,每个档案盒内的纸质资料不能超过 180 页。同时必须将写有档案盒内资料情况说明、整理人、检查人、日期等项目的备考表置于每个档案盒内资料末尾。

 第三十二条 纸质资料除规定的式样及规格外,其余归档资料一律使用 A4 规格的纸质资料。对取得的证据、凭证、票据等小于 A4 规格的,应一律粘贴到 A4 纸上,可以多张同类型的粘贴到一张 A4 纸上,但相互间不得覆盖。对传真资料必须先复印后方可归档。

 第三十三条

 对管户档案、稽查档案应使用市局统一提供的征管档案盒,对声像电子档案、清册档案以及业务档案使用国家标准档案盒。各地均不得私自印制档案盒,也不得随意改变使用档案盒。

 第三十六条

 档案卷宗应依据分类方案和资料编号编制《征管档案卷内目录》和《征管档案案卷目录》(见附件二)。目录应按所归档的征管资料分类填写,并按资料的排列顺序编写页码,《征管档案卷内目录》应置于卷宗之首。(各科室向综合科移交档案时,按照附件二格式一并移送相关 WORD 文档。)

 第三十七条

 纸质档案的装订必须按照“三孔一线”方式进行,打孔位置分别在 1/4、2/4、3/4 处。

 5、页数:是指题名内容所含的资料数量。用阿拉伯数字填写。

 6、备注:填列需要说明的事项。

 2、序号:按顺序排列。

 3、题名:如果为管户档案的一户一档,则第一排书写该纳税人名称,第二排开始按照《办法》第二十六条所列的层级依次书写;如果为多户一档,则按纳税人依次排列;如果为其他档案,按不同的内容排列。

 4、责任者:是管户档案的填税管员,稽查档案的填检查人员,其余的则填列档案内资料取得的责任人员。

 5、页码:是指题名内容对应资料所在的页码位置。如第 1 排则填列“1”,第 1 排内容有 25 页,第 2 排的则填列“26”,所有填列完后,还应在下一排填列终止页码。

 6、备注:填列需要说明的事项。
